Terms And Conditions of a U.D. build commission:
A U.D. guitar is a special thing tailored specifically to you. We now you will love it and if you don’t, We’ll do what we can to make sure you do. Certain factors in a custom build are subjective to personal opinion and taste. Those things will not be covered under a warranty. Flaws, defects and mechanical failures absolutely will be covered.
-We know you are going to fall in love with your U.D. guitar and we guarantee it to be of outstanding “handmade in the USA” quality, but things happen on occasion. In the event of an issue, we guarantee the craftsmanship of every U.D. guitar to be free of defects for a period of two (2) years from the time of delivery to the buyer. We guarantee all components and electronics to be free of defects for a period of five (5) years from that same time of delivery to the buyer. If you encounter an issue with your build, please email: Nick@uncledeathguitars.com for all warranty claims.
-A non-refundable deposit is required to begin each build. This cost is annotated on the quote and is to be considered your official retainer and your agreement to secure a build slot. Once the non-refundable deposit is paid, The agreement for a custom build commission is secured and you (the buyer) acknowledge that you have committed to allow a custom build to begin and to pay the agreed upon final amount once the build is completed. Sourcing materials and parts for the build will begin immediately after the non refundable deposit has been paid and in no case will the deposit be returned.
-Modifications to an agreed upon build commission may only be made if both parties agree upon said modification. Certain modifications may increase build time and the price of the build. In the event that a modification to a build in progress is requested, both parties (Nicholas Adams, U.D. guiyars/builder) and you (buyer) will discuss said modification, agree upon an updated price and lead time.
-The remaining balance of a build must be paid BEFORE the instrument will ship to the buyer. In no case will U.D. guitars be expected to ship an instrument without the full agreed upon amount paid in full. If the remaining balance of a build cannot be paid up within One (1) year of completion, we (Nicholas Adams/U.D. guitars) reserve the right to sell the instrument to another party to recoup labor costs.
-Payment plans are available through U.D. guitars if agreed upon before a commissioned build begins.
-Progress updates: You (the buyer) will receive periodic updates of your build in various stages throughout the entire process. These updates will begin once all the parts necessary to perform the build have been received and work has begun. Once ALL parts are accounted for, The build will formally begin. Backorders, Supply chain issues and the like are sometimes unavoidable. In the case that any component is on backorder, we (U.D. guitars) will contact the buyer and discuss the best course of action. In the event that the buyer chooses to wait for such a backorder to arrive, there will be a temporary “Pause” on the lead time for said build. The pause will expire once that component arrives and that build will commence.
-Ownership: U.D. guitars (Nicholas Adams) reserves the right to use images of any and all custom builds for marketing and social media purposes and U.D. guitars (Nicholas Adams) will perpetually own the intellectual property of any custom shapes designed for any such commission including collaborations. Ownership of the instrument is transferred to you when YOU (the buyer) receive the instrument in person. This means that it is OUR (Nicholas Adams/U.D. guitars) responsibility to ensure safe delivery to you. This also means that if a lovely shipping company decides to break your custom made guitar on it's way to you, it will be on OUR (Nicholas Adams/U.D. guitars) end to file a claim, receive an insurance reimbursement and make your purchase whole by re-making the instrument. In that horrible rare circumstance, of course a new timeline will be agreed upon and the instrument will be replaced.
-U.D. guitars does not offer returns on any guitar.
