Uncle Death Guitars (AKA “U.D. Guitars”)

– Terms and Conditions

These Terms and Conditions ("Agreement") govern all custom guitar builds and services provided by U.D. Guitars, owned and operated by Nicholas Adams ("we", "us", or "U.D. Guitars"). By paying a deposit and commissioning a build, you ("Client", "Buyer", or "you") agree to the following terms:

1. Custom Build Acknowledgment

Each U.D. Guitar is a one-of-a-kind, handcrafted instrument built to your specifications. We are confident you will love your guitar. However, personal preferences regarding certain factors of an instrument are inherently subjective and are not covered under warranty or eligible for return or refund.

2. Warranty Coverage

We stand by the craftsmanship of our instruments.

Covered Under Warranty:

  • Structural defects

  • Mechanical or functional failures

  • Electronic component failures

Warranty Periods:

  • Craftsmanship Warranty: Two (2) years from the date of delivery.

  • Component & Electronics Warranty: Five (5) years from the date of delivery.

Please note: Warranty does not cover wear and tear, misuse, unauthorized modifications, or damage caused by environmental factors outside our direct control.

3. Deposits and Payment Terms

  • A non-refundable deposit is required to initiate each build. The amount will be detailed in your project quote and serves as both a retainer and confirmation of your commitment.

  • Upon receipt of this deposit, your build slot is secured and material sourcing will begin. The deposit will not be refunded under any circumstance, including order cancellation.

  • The remaining balance must be paid in full before shipment of the completed instrument.

  • If the balance is not paid within one (1) year of build completion, U.D. Guitars reserves the right to sell the instrument to recover costs. In such cases, the original deposit remains non-refundable.

4. Modifications to Commissioned Builds

  • Once a deposit is paid and the agreement to commission a custom build from U.D. guitars has been made, NO changes may be made to any custom build.

  • 5. Payment Plans

Payment plans may be available upon request and must be arranged prior to commencement of the build. Contact us directly to discuss options.

6. Build Progress & Delays

  • You will receive regular updates throughout the build process, beginning once all necessary components have been received.

  • If a part is backordered or delayed due to supply chain issues, we will inform you immediately and mutually agree on how to proceed.

  • In the event of such delays, the project timeline will be “paused” until the missing components arrive.

7. Shipping & Delivery

  • Ownership of the instrument transfers to you upon receipt of the guitar.

  • U.D. Guitars is responsible for ensuring safe delivery and will file any necessary shipping insurance claims in the event of damage during transit.

  • If a guitar is damaged during shipping, we will remake the instrument once an insurance claim is approved. A new timeline will be provided in such cases.

8. Returns & Refunds

Due to the custom nature of our instruments, we do not accept returns under any circumstance.

9. Marketing & Intellectual Property

  • U.D. Guitars (Nicholas Adams) retains the right to use images, videos, and descriptions of all custom builds for marketing and social media purposes.

  • We retain all intellectual property rights to any unique guitar shapes or designs created during a commissioned build, including those resulting from collaborative work.

By commissioning a guitar from U.D. Guitars, you acknowledge and accept these terms in full. These Terms and Conditions are subject to change at any time and without notice.

FINISH WORK TERMS AND CONDITIONS:

1. Payment and Deposits

All payments for refinishing and custom finish services by U.D. Guitars must be made in full before shipping your guitar to us and before any work begins. All payments are final and non-refundable.

2. Custom Finish Approval

All custom finish work must be approved by both U.D. Guitars and the customer before the instrument is shipped to our facility. U.D. Guitars reserves the right to decline any custom work at our discretion.

3. Shipping and Risk of Loss

Customers are responsible for all shipping costs to and from U.D. Guitars. We highly recommend using a tracked and insured shipping service.
U.D. Guitars is not liable for any loss, theft, or damage that occurs during shipping. Title and risk of loss remain with the customer at all times during transit.

4. Turnaround Times

Lead times for finish and refinishing work are estimates only and subject to change. These depend on project complexity, materials, and current workload.
Custom finish work may require additional time, and U.D. Guitars is not responsible for delays beyond our control.

5. Workmanship and Warranty Disclaimer

All finish and refinishing work is performed on an “as-is” basis. U.D. Guitars makes no warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
Due to the nature of custom finishes, exact outcomes may vary. Color, texture, and appearance are subject to artistic interpretation and material behavior.

6. Limitation of Liability

To the maximum extent allowed by law, U.D. Guitars is not liable for indirect, incidental, or consequential damages—including but not limited to loss of use, income, or damage to property.
Our total liability shall not exceed the amount paid for the services provided.

7. Acceptance of Terms

By submitting an order and making payment, you acknowledge that you have read, understood, and agreed to these terms and conditions.
These terms are subject to change without notice.

WARNING:
Products and materials used by Uncle Death Guitars (U.D. Guitars) may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

This includes, but is not limited to, certain paints, finishes, adhesives, metal components, and electronic parts used in the construction, refinishing, and customization of guitars. Exposure may occur through skin contact, inhalation, or handling of these materials.

By commissioning a build or using our services, you acknowledge that you have been informed of this risk.
